Terms and Conditions

These Terms & Conditions (“Terms”) govern all landscaping, lawn care, maintenance, and related services (“Services”) provided by Harris Landscape and Design (“Company,” “we,” “our,” or “us”) to residential and commercial clients (“Customer,” “you,” or “your”) located in the state of Tennessee. By requesting or receiving Services from us, you agree to these Terms.


1. Scope of Services

We provide landscaping and lawn care services including but not limited to mowing, trimming, mulching, planting, clean-ups, hardscaping, seasonal services, and property maintenance. The specific Services to be performed will be outlined in your estimate, invoice, or service agreement.


2. Estimates & Pricing

  • All estimates are valid for 30 days unless otherwise stated.
  • Estimates are based on the information available at the time of inspection. Additional work, changes in scope, or unforeseen conditions may result in price adjustments.
  • Any changes requested by the Customer must be approved before work continues.


3. Scheduling & Access

  • Service dates are approximate and may vary due to weather, workload, or seasonal conditions.
  • The Customer must ensure unrestricted access to the property on the scheduled service date (gates unlocked, pets secured, vehicles moved, etc.).
  • If we cannot access the property, a trip fee may be charged.


4. Billing & Payment

  • Payment is due upon completion of Services unless otherwise stated in writing.
  • Recurring services may be billed weekly, bi-weekly, or monthly.
  • Accepted payment methods: [list methods].
  • Late payments may incur a late fee after [X] days.
  • Returned checks may incur a NSF fee.


5. Cancellations & Rescheduling

  • Customers may cancel or reschedule with at least 24 hours’ written notice.
  • Same-day cancellations may result in a cancellation fee.
  • For recurring services, repeated cancellations may result in removal from the schedule.


6. Weather Delays

Tennessee weather can impact service schedules. We reserve the right to delay, reschedule, or modify Services due to rain, storms, extreme heat, or unsafe conditions.


7. Customer Responsibilities

You agree to:

  • Provide accurate information about your property.
  • Maintain safe conditions for our crew.
  • Notify us of underground utilities, irrigation lines, invisible fences, septic systems, or hazards. We are not responsible for damage to unmarked or undisclosed items.


8. Property Conditions

  • Overgrown lawns, excessive debris, or neglected areas may require additional labor and charges.
  • We are not responsible for damage caused by pre-existing conditions, pests, erosion, or structural issues.


9. Liability & Damages

  • We carry general liability insurance as required in Tennessee.
  • We are not liable for indirect, incidental, or consequential damages.
  • Our liability is limited to the cost of the specific Service provided.


10. Warranties

  • Plant material warranties apply only if stated in writing.
  • We do not guarantee plant survival due to weather, pests, improper watering, or customer neglect.
  • Hardscape warranties vary by project and will be outlined in your agreement.


11. Use of Photos

We may take before-and-after photos of work performed. Photos may be used for marketing unless you request in writing that we do not use images of your property. 


12. Termination of Services

We may terminate Services for:

  • Non-payment
  • Unsafe conditions
  • Repeated cancellations
  • Customer misconduct 
  • Customers may terminate recurring services with online (email or text), written notice at a minimum of 24 hours prior to service


13. Compliance With Tennessee Law

These Terms are governed by the laws of the State of Tennessee. Any disputes will be handled in the appropriate Tennessee county court where the service was performed.


14. Updates to Terms

We may update these Terms at any time. The most current version will always be posted on our website.
